Terms and Conditions

The following are the terms of use for the Malaysia Geoportal, which outline your rights and responsibilities when accessing and/or using the services on this portal. By accessing this portal, you are deemed to have acknowledged and agreed to be bound by these terms, thereby forming an agreement between you, as the user, and us, the Government of Malaysia, for the purpose of accessing and/or using this portal. These terms shall supersede any previous terms that may have been accepted or accessed through this portal. Your continued access to and/or use of these services shall be deemed as acceptance of these terms.

 

Limitation of Liability

You clearly understood and agreed that the Malaysian Government shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill or other intangible losses resulting from:

  • the use or inability to use the portal;
  • the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the portal;
  • unauthorised access to or alteration of your transmission or data;
  • statements or conduct of any third party on the portal; or
  • any other matter relating to the portal.

The Malaysian Government may provide links to other websites. Such linked websites are owned and operated by third parties and as such, the Malaysian Government has no control over such sites and resources. You are acknowledged and agreed that the Malaysian Government is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any contents, advertising, products, or other materials on or available from such sites or resources.You are further acknowledged and agreed that the Malaysian Government shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such site or resource.

 

Termination

The Malaysian Government may terminate your access to any part or all of the service and to any related service(s) at any time, with or without cause, with or without notice, with immediate effect. The Malaysian Government may also terminate or suspend your account for inactivity, which is defined as failing to sign-in to the service for an extended period of time. You agreed that the Malaysian Government shall not be liable to you or to any third party for any termination of your access to the Service.

 

Modifications to the Terms of Service

The Malaysian Government reserves the right at all times to change, modify, delete or add to these Terms and Conditions by giving you prior notice thereof. However, in cases of emergency or in order to protect the security of the portal or in other circumstances beyond our control, when the Malaysian Government finds it necessary to change, modify, delete or add to these Terms and Conditions, it may do so without prior notice to you. It is accepted that in order to keep yourself up-to-date with any variation, modification, deletion or addition to these Terms and Conditions, you agree to access and peruse these Terms and Conditions periodically and on a regular basis. You further agree and accept that your continued access and use of these Terms and Condition (as varied or modified from time to time) will amount to your acceptance of any changes, deletion, modification or addition to these Terms and Conditions.

 

Modifications to the Services

The Government of Malaysia reserves the right to modify or terminate the service (or any part of it), whether temporarily or permanently, at any time with or without notice. You agree that the Government of Malaysia shall not be held liable to you or any third party for any modification, suspension, or termination of its services.

 

General

These Terms and Conditions shall be read in conjunction with the Standard Terms. In the event of any inconsistency or conflict between these Terms and Conditions and the Standard Terms, these Terms and Conditions shall prevail, but only to the extent of such inconsistency or conflict. The headings used in these Terms and Conditions are for reference and convenience only and shall not affect the interpretation or construction of any provision herein. If any provision of these Terms and Conditions is found to be unlawful or invalid under current or future applicable laws or regulations, such provision shall be deemed severable and shall not affect the validity or enforceability of the remaining provisions, which shall remain in full force and effect as if the invalid provision had never been included.
